Please read these Terms of Service (“Terms”) carefully before using the www.mhatours.com website (the “Website”) and before booking any tour or opting in to receive SMS text messages from Mormon Heritage Association Inc, doing business as MHA Tours (“MHA Tours”, “we”, “us”, “our”). Your access to and use of the Website, your tour booking with us, and your participation in our SMS messaging program are conditional upon your acceptance of and compliance with these Terms. By accessing or using the Website, booking a tour, or opting in to receive SMS from us, you agree to be bound by these Terms. If you disagree with any part of these Terms, you must not use the Website, book tours, or receive SMS from us.

Mormon Heritage Association Inc, doing business as MHA Tours, is an independent, private entity offering tours focused on history of The Church of Jesus Christ of Latter-day Saints and related destinations. We are not an official representative of nor endorsed by The Church of Jesus Christ of Latter-day Saints.
2. Website Offers and Pricing
We offer information about tours, tour registration, and related services through this Website. Tour prices are listed on the Website, in brochures, and/or in confirmation materials and are subject to change at any time prior to your booking. Unless otherwise stated, listed prices are cash or check prices and do not include taxes, government fees, or optional add-ons.
3. Tour Payments, Deposits, and Fees
- A deposit secures a seat on a tour; payment in full is due on or before the date specified in your Confirmation Letter.
- Prices listed are cash or check prices.
- Balance payment by card (debit or credit) incurs a 5% non‑refundable fee added to the payment.
- Balance payment via Venmo incurs a 2% non‑refundable fee added to the payment.
- To pay by card, call our office at 801‑272‑5601; to pay via Venmo, call or text 801‑272‑5601 for account details.
Continuing with your tour reservation, including paying a deposit or balance, signals your consent to the terms in this document.
4. What Tour Prices Do and Do Not Include
Unless specifically stated otherwise in your tour materials, tour prices do not include:
- Rare fuel surcharges
- Checked baggage fees
- Driver gratuities
- Items of a personal nature
- Government ID, passport, visa, or electronic travel authorization costs
- Tour interruption costs (see Section 6)
- Any other items not expressly listed as “included” in the itinerary or Confirmation Letter
Please review your specific itinerary for inclusions/exclusions for your tour.
5. Cancellations, Changes, and Refunds
Our general policy is to recover and refund to you whatever we can recover, handled on a case‑by‑case basis, largely dependent on timing and vendor policies.
- Before tour commencement
- Cancellations are managed individually as to refundability.
- A minimum $50 per person cancellation/administrative fee applies.
- If MHA Tours has purchased or is committed to purchasing airline tickets on your behalf, airline rules regarding refunds, future credit, change fees, and/or forfeiture apply.
- If someone takes your place, your refund will not include any costs we incur to procure your replacement/make changes, plus the $50 cancellation/administrative fee.
- After tour commencement
- Once a tour commences, all payments are 100% non‑refundable.
- Missed services, meals, transportation, activities, and admissions are non‑refundable.
- Airline tickets
- For “group” airline tickets purchased by MHA Tours, we can usually change the name on the ticket up to 72 hours before departure, subject to airline rules and any fees.
- “Individual” airline tickets are governed solely by the airline’s policy and are not name‑changeable.
MHA Tours reserves the right to cancel or modify a tour or portion thereof at our sole discretion, including for insufficient enrollment, safety concerns, or circumstances beyond our control.
6. Tour Interruption and Force Majeure
Travel inherently involves risks of delays, disruptions, and changes. In the unusual event we are unable to carry through with any or all planned services and/or facilities arranged through any vendor due to causes beyond our reasonable control, including but not limited to:
- Flight delays or other transportation interruptions
- Strikes, lock‑outs, or work stoppages
- Bad weather, fire, flood
- Epidemic or pandemic
- Threats, riots, terrorist activities, insurrections
- Acts or orders of civil or military authority
- Emergencies, injuries, illness
- Acts of God
- Any other cause or circumstance beyond the reasonable control of MHA Tours or its agents then MHA Tours and its agents cannot assume responsibility for and cannot be held liable for any injury, loss, or additional costs caused thereby. MHA Tours may terminate the tour if such delay or default will prevent successful performance of the tour.
If such circumstances occur during a tour, we will use reasonable efforts to meet travel and/or accommodation needs of affected tour members, and affected members agree to reimburse MHA Tours for any additional costs incurred, upon invoice from MHA Tours. Travelers are strongly advised to carry cash and a credit/debit card for such situations.
7. Travel Insurance and Health Coverage
Travel insurance is optional and not available for purchase through MHA Tours. Policies may be available online, through airlines, or through your credit card provider if used for tour payment. Purchasing a travel insurance policy is entirely at the traveler’s discretion.You are responsible to verify that any chosen policy covers the events, conditions, and geographic locations relevant to your travel and to carry proof of any trip insurance and health insurance coverage with you.
8. Traveler Fitness, Accessibility, and Special Needs
Tour members are required to:
- Be fit to travel independently
- Keep up with the pace of the tour
- Manage their own belongings (including luggage)
- Be willing and able to follow instructions given by MHA Tours and its directors and agents at all times
You should be prepared to stand for periods of time, walk distances, climb hills and stairs, and handle lengthy days. There may be times when you may rest on the bus or a bench rather than visit a site; notify your tour guide if you plan to skip any portion of the tour.
MHA Tours will accommodate disabled or less‑abled travelers to the extent reasonably possible; however, certain itineraries and/or tour features are not accessible to wheelchairs, walkers, scooters, crutches, etc., due to terrain, historic buildings, or other conditions. Please inquire with MHA Tours in advance if you have specific needs or questions.
Travelers with specific dietary restrictions must coordinate and confirm such needs with MHA Tours at registration or no later than one month prior to departure. With later notice, we cannot assure the ability to accommodate dietary requests. Regardless, travelers with dietary restrictions should bring supplemental food items at their own discretion.
9. Accounts and User Content on the Website
If you create an account on our Website, you represent that you are at least 18 years old and that the information you provide is accurate, complete, and current. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. We may terminate or suspend accounts at our sole discretion.
By submitting comments or uploading content to the Website, you grant MHA Tours a worldwide, non‑exclusive, perpetual, royalty‑free license to reproduce, publish, and distribute that content. You are responsible for ensuring that your content complies with applicable law and does not infringe others’ rights. We may remove any content at our discretion.
10. Prohibited Uses of the Website
You agree not to use the Website in any way that violates applicable laws or these Terms. Prohibited uses include, without limitation, attempting to gain unauthorized access to the Website, sending spam, introducing malicious code, or engaging in actions that interfere with the proper operation of the Website or others’ use of it.
11. SMS Messaging Program (A2P 10DLC)
We offer an SMS messaging program to provide tour updates, reminders, and limited promotional information. By providing your mobile number and expressly opting in (for example, by checking a box on a form or texting in a keyword), you consent to receive text messages from MHA Tours at the mobile number you provided.

- After you send STOP, you may receive one final message confirming your opt‑out; no further messages will be sent unless you re‑enroll.

- Supported carriers and availability
- Delivery of SMS messages may be affected by your carrier’s network and other factors beyond our control; we are not liable for delayed or undelivered messages.

12. No Warranties
The Website, tours, and related services are provided “as is” without any warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non‑infringement. 13. Limitation of Liability
To the fullest extent permitted by law, MHA Tours and its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from or related to:

- Participation in any tour or MHA event
- Delays, interruptions, or changes in travel arrangements as described in Section 6
- Use of our SMS messaging program
In any event, our total aggregate liability to you for all claims arising out of or related to any tour or use of the Website will not exceed the total fees you paid to MHA Tours for the tour giving rise to the claim.

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms, any tour, or your use of the Website shall be brought exclusively in the state or federal courts located in the State of Utah, and you consent to the jurisdiction of such courts.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
